Terms and Conditions (“Terms”)

1.      Introduction

Please read these Terms and Conditions “Terms” carefully before using the http://wwwgallowayleather.co.uk website operated by egallowayleatherdesign also now referred to as egallowayleather (“us”, “we”, “our”, “I”, or “my”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

2.       Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

4.      Information Accuracy

We do our best to ensure that the information on this website which includes amongst other things; pricing information, product descriptions and stock quantities is accurate and up to date. However though we try and avoid this there may be occasions when information is inaccurate, has not been updated or where it changes without notice.

We will try and flag up any updates to product descriptions, however please check carefully as updating is done regularly and it is not always possible to flag every change.

We make every effort to display accurate images and descriptions of our products, and we carefully photograph all our products. However sometimes especially due to the nature of leather, some minor variations in appearance can occur especially with pull-up style leathers such as the waxy goatskin. These naturally occurring variations do not represent faults within the leather or within the products.

As a small business we are particularly susceptible to fluctuations in the prices of our raw materials and pricing information can change at any time. This may affect a customer’s choice e.g. thread stitching colour where we may have to apply specific prices to different variations.

In some cases we may be unable to provide something which was previously available on the website. In the event of this we will make every effort to remove this option from the product description ASAP, however should this remain and a customer order were to be placed, we will contact the customer at the soonest opportunity available in order to discuss their options, e.g. to choose another similar option instead or to arrange a refund.

5.      Terms of Sale

By placing orders on the website customers represent that the information they provide is true and accurate.

6.      Payment Terms/Purchases

The website currently provides facilities for card payments, using the Swipe Payment Platform, however egallowayleather reserves the right to change this at any point in the future without prior notice.

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase.

Payment via the website

All items ordered through the website are paid for using the Payment Platform provided on the website, this is currently ‘Stripe’ this platform you are subject to their conditions.

For items listed on the website, full payment is due at checkout. Although we will endeavour to alert customers in advance of any changes to the payment processing methods used on our site, egallowayleatherdesign reserve the right to change these if necessary and without prior notice.

Payment for Repair Service

If you are not ordering products through the shopping page but are seeking a repair made to an item you already own, (not made by egallowayleather) then you may be asked to pay a deposit before work can commence and to pay the balance before the item is posted out to you, or to pay the balance on collection from the workshop.

In some circumstances you may be asked for full payment in advance, e.g. with a project where an expensive piece of leather has to be purchased in order to start the project. Payment in advancedepends on the nature of the project and is at the discretion of egallowayleather.

Payment for repairs can be made in person on collection, with cash or other payment methods supported by the Zettle platform. Otherwise payment is via invoice and BACS payment is preferred. Payment is expected within 30 days.

Payment for Bespoke Service

If you are not ordering products through the shopping page but are seeking a bespoke item, then you may be asked to pay a deposit before work can commence and to pay the balance before the item is posted out to you, or to pay the balance on collection from the workshop.

In some circumstances you may be asked for full payment in advance, e.g. with a project where an expensive piece of leather has to be purchased in order to start the project.

Payment in advance depends on the nature of the project and is at the discretion of egallowayleather.

Payment for bespoke projects can be made in person on collection, with cash or other payment methods supported by the Zettle platform. Otherwise payment is via invoice and BACS payment is preferred. Payment is expected within 30 days.

Payment in person

Collection in person is only available through prior arrangement and cannot be arranged during the checkout process on the website.

When collecting in person egallowayleatherdesign currently takes payment using the Zettle Payment processing service. We take no responsibility for any changes made to the Zettle Payment processing which may affect a customers’ ability to pay.

We reserve the right to change the payment processing service at any time.

Cash Payments are only accepted when collecting in person. This is only available by prior arrangement and at the discretion of egallowayleatherdesign. It is not available to book through the website.

Payments made from Abroad

We currently do not take payment from or ship to areas outside of the United Kingdom.

7.      Lead Times/Delivery/Shipping

Lead Times

Items are Made To Order unless otherwise specified. Lead times are one to two weeks unless otherwise specified.

Should the workshop have to be closed for any reason, egallowayleatherdesign will endeavour to give advanced notice on the website. However we reserve the right to close the workshop at any time if it is deemed necessary.

Delivery/Shipping

We currently use the Royal Mail First Class signed for delivery service, and according to Royal Mail, your parcel should arrive the next day after being posted by us, (including Saturdays). However this is not a guarantee.

Please note that as of Saturday 14thMarch 2020 due to the current Coronavirus situation the recipient will not be asked to sign for the parcel.

The delivery cost stated above is included in the price of your accessory.

Should the loss or delay of parcels occur while in the possession of Royal Mail, (or another carrier chosen by us), we will do our utmost to rectify the situation.

If the customer has specified the use of a different carrier, then the customer will be obliged to pursue any loss or delay of parcels.

However we reserve the right to send your parcel using another carrier and using a similar tracked delivery service if we deem it necessary.

We currently do not take payment from or ship to areas outside of the United Kingdom.

8.      Intellectual property

Nothing contained within the website should be interpreted as granting any license or the right to use any trademark without the prior written consent of egallowayleather. Therefore any kind of reproduction of the site content and features without permission from egallowayleather is strictly prohibited.

9.      Disclaimer of liability

egallowayleather cannot accept liability for damage or breakages where an item has not been used for its intended purposes. Or where the item has not been cared for in the way described in the care section.

10.    External Links

This website may contain links to third party web sites or services that are not owned or controlled by egallowayleather. Any links directing the customer away from egallowayleather are provided for the convenience of the customer only.

Any third party websites or platforms featured on the website are outside of our control. egallowayleather is not responsible for the content, quality, character privacy policies or practices or reliability of third party websites, platforms or services.

The inclusion of third party links does not imply an endorsement by egallowayleather.

You further acknowledge and agree that egallowayleatherdesignshall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

11.    Terms of Use

This website must not be used in order to violate the rights of any party. We reserve the right to prevent anyone violating the terms of use from accessing the website.

12.    Prices

All prices are inclusive of UK VAT, (currently 20%) and postage (Royal Mail first class signed for) unless otherwise stated.

13.    Customer Details

egallowayleather do not hold details of customer card details. Card transactions are made using Payment Platforms which are currently ‘Stripe’ if using the website and a ‘Zettle’ card reader for face-to-face sales. Any postal addresses we hold for a customer are for processing an order e.g. postal address. This information will not be passed on to third parties.

14.    Products

egallowayleather supplies high quality hand crafted leather items made in the uk. Most of these items will be stitched by hand. We do not use a sewing machine.

Guarantees and Warranty

With good care your leather accessory may well outlive you. If something on your leather accessory breaks, we will mend this free of charge provided that the item has only been used for its intended use and that the accessory has been properly and regularly cared for.

The free repair does not apply to items not made by egallowayleather.

Leather is not inherently a waterproof product and as such requires regular maintenance to ensure longevity. We recommend using Fiebings 4 Way or Sedgewick’s & Co leather care, on our leather products. Please refer to the care and polishing section on this website for usage instructions.

15.    Returns, Exchanges, Order Cancellation

Since all my products are made to order, I would prefer to exchange a product, however if you are not satisfied, a refund can be arranged.

A Refund will be given once the product has been returned at the expense of the customer; in the condition it was received, 14 days from postal receipt. Proof of postage required. Refund will be for total amount paid not including return postage. 

Please note that a refund, exchange or cancellation is not available where a customer has damaged the goods by using it for a purpose(s) it was not intended for.

Please email as soon as possible if you would like to cancel, exchange or would like a refund as these matters are best dealt with in person.
